Privacy Policy
1. Purpose
- Great Divide Mining (‘the Company’) has developed this Privacy Policy (‘the Policy’) in order to ensure compliance with its obligations regarding the collection, use, disclosure and retention of personal information.
- The Company is committed to complying with the Australian Privacy Principles under the Privacy Act 1988 (Cth) (Privacy Act).
2. Scope
- This Policy applies to all personal information collected by the Company in the course of its business.
3. Collection and Retention of Information
- The Company may collect for inclusion in a record and hold the following types of personal information:
- name, address, date of birth and information or opinion about character, capabilities, performance and other attributes of staff and potential staff members and potential and actual contractors and tax identifiers, bank account details and insurance information (including workers compensation insurance information) about contractors;
- name, address, date of birth and other relevant information about customers to enable the proper administration of the Company’s relationship with the customer, internal planning, and regulatory reporting;
- name, address, financial product holdings and dealings, bank account details, and tax identifiers of holders or potential holders of financial products issued by the Company;
- information disclosed by users of the Company’s IT systems collected in the ordinary course of use;
- name, address, email address and information about roles and personal attributes of representatives of organisations the Company deals with.
- The Company may collect or hold sensitive information as required by law or to fulfil employment obligations. Consent will be obtained unless otherwise required by law.
- If the Company receives unsolicited personal information, it will only be kept if reasonably necessary for its functions or activities.
- The Company will use only lawful and fair means of collecting personal information.
- Information may be held in both hard copy and electronic form with restricted access as appropriate.
4. Use and Disclosure of Information
- The Company uses and discloses personal information for:
- delivering services;
- promoting services;
- administering business activities;
- facilitating alumni and communication activities;
- complying with legal obligations.
- The Company will not disclose personal information except:
- as described in this Policy;
- with the individual’s consent; or
- where data is de-identified.
- The Company ensures disclosures to third parties are limited to necessary and accurate information and that third parties comply with relevant laws.
- Other disclosures may occur where:
- the individual would reasonably expect it (e.g. training, quality assurance);
- required for fee recovery;
- authorised or compelled by law;
- to prevent or reduce a serious threat;
- relating to unlawful activity or misconduct;
- to locate a missing person;
- for legal claims;
- requested by enforcement agencies;
- for complaint investigations or dispute resolution.
- The Company is unlikely to disclose information overseas except for overseas operations, and only where protections are comparable to Australian standards.
- The Company maintains accuracy and security of personal records with procedures to protect from misuse or unauthorised access.
- Personal information no longer required will be destroyed or de-identified unless retention is required by law.
5. Access and Correction of Information
- Individuals should contact the Company to update inaccurate or outdated information.
- Individuals may request access to their information unless it:
- was provided anonymously;
- includes third-party data not authorised for access;
- would present a safety risk.
- Access refusals will include written reasons.
- If correction is refused, a note can be added at the individual’s request indicating their position.
- No charge applies for access requests, but reasonable costs (e.g. photocopying) may be passed on with prior notice.
6. Privacy Complaints
- Privacy complaints should be directed to the Company’s Privacy Officer, who will review the matter.
- If unresolved, individuals may escalate complaints to the Office of the Australian Information Commissioner (oaic.gov.au).
